A man has been arrested in Lismore for refusing to do a drug test.

A 45-year-old East Lismore man who sped away from police when he was signalled to stop on Monday was charged with refusing to take a drug test after being cleared of drink driving.

And despite being banned from driving for 24 hours, the man was again arrested earlier this morning for a similar matter, although this time he allegedly kicked out the window of a police car and tried to engage the automatic gear shift.

Richmond Local Area command police allege that the man was ‘highly confrontational’ when initially stopped by police around 11.45am on Monday.

He passed a roadside breath test for alcohol but then refused to participate in a roadside drug test.

Police arrested the man and he was taken to the Lismore Police Station where he refused to take an oral fluid test.

He was charged with refuse or fail to submit to an oral test and refuse or fail to provide an oral sample (second offence).

The East Lismore man had his license suspended for 24 hours and will appear in the Lismore Local Court in April.

The man was arrested again this morning around 9am after police noticed he was driving again.

The man allegedly confronted police in an aggressive manner and again refused to do a roadside drug test.

He was placed under arrest and seated in the rear of a police sedan. The 45-year-old has then kicked out a window and made his way out of the sedan. He has then entered the front passenger of the police sedan and tried to engage the automatic gear shift.

Police wrestled the man out of the vehicle and were forced to use capsicum spray to control him.

At Lismore police station the man has again refused to take an oral fluid test.

Police said he would be charged with Refuse or fail to submit to oral fluid test, Refuse or fail to provide oral fluid sample – 2nd offence, Malicious Damage, two counts of Assault Police and two counts of Resist Police.
