The Fair Work Commission has found that Southern Cross University misled staff in an effort to have an enterprise agreement approved.
SCU was found to have misled staff during a non-union voting ballot by offering a $750 sign-on bonus in return for supporting the agreement.

The agreement was approved by the Commission after a ballot win last year, but the National Tertiary Education Union appealed to the full bench.
The appeal was upheld, with the Commission finding that SCU sent emails offering a $750 ‘sign-on bonus’ to all casual staff once a majority of staff had voted in favour.
These emails were found to be ‘misleading on their face’ and hence the agreement was not ‘genuinely agreed’.
