Shark culls not the answer

It has been a confronting and devastating year with a 12-year-old killed by a shark in Sydney and another shark attack in Coogee over the weekend. The NSW government has said there is nothing off the table in response to the latest shark incident. But it is vital that we don’t just start going out there and randomly culling sharks.

Morrison Avenue a ‘disgrace’

Local Mullumbimby residents are saying Byron Shire Council (BSC) needs to step up and fix Morrison Avenue properly.

In an open letter to the NSW Premier, Attorney-General, Minister for Police, and Commissioner of Police, advocates and civil society organisations have called for the charges to be dropped against people protesting against the visit of the President of Israel on 9 February 2026.

They write: ‘We, the undersigned, call on the government to immediately drop all the charges against people protesting against the visit of the President of Israel on 9 February 2026 on the basis that all charges are a direct consequence of unlawful conduct by the police’.

‘The scenes of peaceful protest being met with police brutality at Town Hall on 9 February 2026 remain at the forefront of our minds. Protestors were punched, dragged out, and indiscriminately pepper sprayed. Peaceful worshippers were attacked, as were protestors trying to leave. Horses and police officers charged into the crowd, while kettling and other unsafe crowd control tactics left protestors with broken bones and battered bodies. These are not scenes that belong on our streets.

‘Dozens of protestors, exercising a fundamental civil right to voice their opposition by peaceful protest to the visit to Australia of a foreign Head of State, the representative of a State committing a genocide [1] on the Palestinian people, are now being subjected to further oppression by the government in facing criminal proceedings.

‘This was the tragic and unnecessary sequel to the 1978 Mardi Gras – another shameful moment in the history of policing and protest in this country.

‘Just like those arrested and charged for participating in the 1978 Mardi Gras, the charges against protestors at the Herzog rally cannot stand.

‘The violence at Town Hall on 9 February 2026 was first and foremost a direct consequence of unconstitutional law-making [2]. The invalid Public Assembly Restriction Declaration (PARD) scheme was central to the policing approach that evening. It is impossible to disentangle the consequences – whether by way of a failure to comply with a move on order, resisting an officer or responding physically to police use of force – from the police enforcement of the PARD and it would be disingenuous to attempt to do so. The protest was in fact “authorised” under the Summary Offences Act 1988 [3]. The NSW Police were warned of this fact before the protest in writing by the organisers. Police should not have interfered with protestors seeking to march on the road to Parliament House. The police conduct in doing so cannot be justified by law. It was a procession protected under the Summary Offences Act scheme.

‘The existence of a declaration under the Major Events Act 2009 has been referred to as an independent basis upon which to maintain charges. This is misconceived [4]. In any event, the lawfulness of using the Major Events Act powers in these circumstances is highly contested and the provisions are significantly constitutionally vulnerable. They should not be used as a basis for substantiating or maintaining any of the charges.

‘The response by police was not a proportionate reaction to spontaneous public disorder. It was a pre-emptive enforcement strategy directed at stopping and interfering with a peaceful political assembly and procession and motivated by political considerations.

‘In New South Wales, evidence obtained in consequence of unlawful or improper conduct is presumed inadmissible [5]. All of the evidence in relation to the protest is tainted by the unlawful and improper use of powers by police.

‘An intransigent perseverance with the charges will lead to failed prosecutions, large costs orders against the State and further harm to protestors.

‘These charges are being maintained by the NSW Police Prosecution Service. A police prosecutor, employed by the NSW Police Force, who is not independent of the police command in which orders and decisions were made at the Herzog protest, cannot, and cannot be seen to, appropriately discharge the function of an independent, impartial and fair prosecutor. Their role in these proceedings is attended by a conflict of interest. Public confidence in the police and the administration of justice generally has been undermined by the way in which police acted at the Herzog rally and this is only compounded by the maintenance of criminal proceedings by the police against protestors.

‘We call on the government to immediately drop all the charges against people protesting on 9 February 2026.

‘In the event that call is not heeded, we further call on the NSW Police Force to immediately transfer all prosecutions to the Director of Public Prosecutions’, they say.

Local filmmaker Darius Devas is bringing Floodland – winner of the Sustainable Futures Award at the Sydney Film Festival – to Mullumbimby, for one night only.

Following a sold-out inaugural event in 2025, Mullum Roots Festival returns bigger and bolder, taking over Mullumbimby with an expanded program, and an additional venue. The new space will host a Youth Battle Of The Bands and give more room for music lovers to gather, celebrate and connect.
