The man who drove a car that killed 28-year-old Shaun Zagar and his two children on Martins Road in Dyraaba in early June will remain behind bars until his court case resumes on December 17.
Malcolm Joseph Harris, 36, appeared in Lismore Local Court yesterday to answer charges of driving under the influence, dangerous driving occasioning death and driving while disqualified.
The court previously heard that Harris tested positive for alcohol and a ‘cocktail’ of other drugs including methadone, diazepam and marijuana; that he had previously had his licence cancelled until 2030; and that he was driving the car without the permission of its owner.
Shaun Zagar, 28, his son Kaleb, 6, and daughter Zara, 5, were sitting in his parked car by the side of the road, near the school bus stop at the intersection with McDonalds Bridge Road, when the accident occurred at around 8.15am on June 4.
They were killed when Harris’s car allegedly veered to the wrong side of the narrow country road and ploughed into their vehicle.
The force of the accident pushed both cars off the road into an adjacent paddock.
